When we go to the hospital or doctor’s office in need, it is our expectation that we will be seen by a competent staff. However, what happens when that isn’t the case. There have been some instances where healthcare professionals refuse to provide care. The question many of us may ask is can they do that. That will be the focus of this week’s assignment.

ULO3: Analyze the ethical implications of a provider’s refusal to treat a patient (CLO 1).
Requirements
Carefully read Guadalupe T. Benitez v. North Coast Women’s Care Medical Group, et. al., San Diego County Super.
Ct. No. GIC770165 (1999) . This is a case of a provider refusing to treat an unmarried woman for fertility issues.
The students are expected to summarize the facts of the case (what happened that led to the lawsuit and how it progressed through the courts) and prepare a case brief using the IRAC method. IRAC (Issue, Rule, Analysis, and Conclusion) is an acronym for a method for summarizing legal opinions. The “Issue” is the question or problem that the court was addressing (this should be in a form of a question). The “Rule” is how the court answered the issue and the relevant law the court used to solve the issue question. The “Analysis” is only the summary of the court analysis – how the court applied the rule to the facts. Finally, the “Conclusion” first note the final outcome of the case – the court’s ultimate finding. Then, evaluate the significance of the case. (Tip: there is no wrong conclusion unless it is totally unsupported). This is your, the student’s commentary on the case, from your point of view (which is not a lawyer point of view) as an administrator or a risk manager of a healthcare facility. Conclusion is NOT simply a summary of what has been stated above.
Case Study: The students are expected to carefully read the assignment instructions, then thoroughly and explicitly address each component of the case summary and brief. The submission should reflect higher-level cognitive processing (analysis, synthesis, and evaluation), which is essential for someone being prepared to serve in an operational capacity within the healthcare and related industry.
To earn the maximum number of points, the submission should reflect college-level execution with clear evidence of critical thinking, synthesis of relevant information from credible sources, and clear mastery of the concepts necessary to successfully execute each component of the assignment.
This submission should not exceed two (2) pages in length, excluding the title and reference list pages, and explicitly address all required components of this assignment. If more pages would be needed, then the business letter can be accompanied by an attachment to add more detailed information.
The submission should be prepared as a practical business deliverable (single-spaced) and include at least three (3) references of credible or peer-reviewed sources to support any suppositions and recommendations.
The in-text citations and the list of references must adhere to the APA writing style (7th ed.).
